1. Purpose

These Terms of Use ("Terms") set out the conditions for accessing and using the CompetHub service (the "Service"), an online platform that assists with the management of sports competitions: creating competitions, registrations, categories, brackets, scoring, scheduling and the publication of a public results page.

The Service is published and made available free of charge, on a non-professional and voluntary basis. As it stands, it does not give rise to any financial consideration on the part of the user.

2. Definitions

  • "Publishers": the natural persons who publish and make the Service available, as identified in the legal notice.
  • "Service" or "Platform": the CompetHub application and all of its features.
  • "User": any person accessing the Service, whether or not they have an account.
  • "Organizer": the user who creates and administers a competition, as well as the members of their staff.
  • "Athlete" or "Participant": the person registered for a competition, whether or not they have an account.
  • "Content": any data, information or item entered, imported or published by a user on the Service, in particular data relating to competitions and participants.

3. Acceptance of the Terms

Use of the Service requires full and unreserved acceptance of these Terms. A user who does not accept them must stop using the Service. The applicable Terms are those in force on the date the Service is used.

4. Access to the Service and account

Certain features require the creation of an account. The user undertakes to provide accurate information and to keep it up to date.

  • The user is solely responsible for the confidentiality of their login credentials and for any activity carried out from their account.
  • The Service is intended for persons with legal capacity. A minor may only create an account with the consent of their legal representative.
  • The Publishers reserve the right to refuse, suspend or delete an account in the event of a breach of these Terms, without compensation.

5. Description and evolution of the Service

The Service is provided "as is" and "as available". It is liable to change: features may be added, modified, restricted or removed at any time, without notice or compensation, in particular given its free nature and its stage of development.

The Publishers do not guarantee that the Service will be uninterrupted, error-free or permanently available. Maintenance operations, upgrades or technical incidents may make it temporarily inaccessible.

6. User obligations

The user undertakes to use the Service in a fair and lawful manner and in accordance with its intended purpose. In particular, they shall refrain from:

  • publishing or entering any Content that is unlawful, defamatory, insulting, contrary to public order or to the rights of third parties;
  • infringing the intellectual property rights or personal data of third parties;
  • disrupting, overloading or compromising the operation or security of the Service (intrusion, injection, bots, mass data extraction, circumvention of technical measures);
  • impersonating a third party or creating accounts fraudulently;
  • using the Service for purposes that are unauthorized or contrary to these Terms.

The user is solely responsible for the use they make of the Service and for the Content they publish on it.

7. Role and responsibility of Organizers

The Service is a neutral management tool. The Publishers do not organize competitions and are not party to the relationships between Organizers, their staff, athletes, clubs, federations or spectators.

The Organizer is solely responsible for the competition they create and manage, and in particular for:

  • the practical organization, safety, insurance, authorizations and compliance with the applicable sporting and federal rules;
  • the accuracy, lawfulness and updating of the Content and data they enter, including data relating to participants;
  • having a legal basis and, where applicable, the consent of participants (or their legal representatives for minors) to enter and publish their data;
  • the public nature of the information they choose to publish on the competition’s public page.

With regard to the personal data of participants that they enter, the Organizer acts as data controller; the Publishers act as a mere technical service provider (processor) within the meaning of the GDPR. This is detailed in the Privacy Policy.

8. Content published by users

The user retains ownership of the Content they publish. They warrant that they hold all the rights and authorizations necessary for its publication and indemnify the Publishers against any third-party claim in this respect.

The user grants the Publishers a non-exclusive, royalty-free license to host, reproduce and display their Content, solely to the extent necessary for the operation and provision of the Service.

In their capacity as host, the Publishers are not subject to a general obligation to monitor Content. They may nonetheless remove any Content that is manifestly unlawful or contrary to the Terms as soon as they become aware of it, without this engaging their liability.

9. Intellectual property of the Service

The Service, its structure, code, interfaces, name and visual identity are the exclusive property of the Publishers and are protected by applicable law. These Terms grant the user no ownership right over the Service, but merely a personal, non-exclusive and non-transferable right of use for the duration of their use.

10. Personal data

The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

11. Warranties and limitation of liability

As the Service is provided free of charge and "as is", it is agreed, to the fullest extent permitted by law, that:

  • the Publishers provide no warranty, express or implied, as to the Service’s fitness for a particular purpose, its continuity, reliability, accuracy or freedom from errors;
  • the Publishers may not be held liable for indirect damage (loss of data, loss of business, loss of opportunity, harm to image) resulting from the use of, or inability to use, the Service;
  • the Publishers are not responsible for the Content, decisions, results, rankings or disputes that fall to Organizers or users;
  • the user is responsible for backing up their own data and is encouraged to export important information regularly.

In accordance with applicable law, the Publishers’ liability may in any event only be engaged in the case of gross or intentional fault personally attributable to them. Nothing in these Terms has the effect of excluding or limiting liability that cannot be excluded or limited under the law.

12. Force majeure

The Publishers’ liability cannot be engaged in the event of non-performance or delay attributable to a case of force majeure within the meaning of Article 1218 of the French Civil Code, or to an event beyond their reasonable control (in particular failure of networks, of the host or of a third-party provider).

13. Suspension and termination

The user may stop using the Service and request the deletion of their account at any time. The Publishers may suspend or remove access to the Service, in whole or in part, in particular in the event of a breach of the Terms, a security risk or discontinuation of the Service, without compensation, the Service being free of charge.

If the Service is discontinued, the Publishers will endeavour, as far as possible, to inform users so that they can retrieve their data, without this constituting an obligation to achieve a specific result.

14. Amendment of the Terms

The Publishers may amend these Terms at any time, in order to adapt them to changes in the Service or in the legal framework. The applicable Terms are those in force at the time of use. Continued use of the Service after an amendment constitutes acceptance of the new Terms.

15. Third-party links and services

The Service may contain links to third-party sites or services, over which the Publishers exercise no control and for which they decline all responsibility.

16. Governing law and disputes

These Terms are governed by French law.

In the event of a dispute, the user is invited to contact the Publishers first in order to seek an amicable solution. Failing an amicable resolution, the dispute will be brought before the competent French courts under ordinary law.
